BE IT RESOLVED THAT the Council of the Corporation of the Town of Bancroft does hereby approve of the open session agenda dated July 11th, 2022, as presented.

WHEREAS the Council of the Corporation of the County of Hastings, at its meeting of March 25, 2021, granted approval subject to the conditions, to Draft Plan of Subdivision No. 12T-20-002, under Section 51 of the Planning Act, R.S.O. 1990, C.P. 13, as amended; AND WHEREAS as a condition to Draft Approval for Plan of Subdivision for File No. 12T-20-002 the Council of the Corporation of the Town of Bancroft, at its meeting of April 12, 2022, passed By-law No. 38-2022 authorizing the Corporation to enter into a Subdivision Agreement with Bancroft Ridge Developments Inc. in accordance with section 51(26) of the Planning Act, R.S.O. 1990, C.P. 13, as amended; AND WHEREAS the Council of the Corporation of the County of Hastings, at its meeting of April 28, 2022, granted final approval for Phase 1 of Draft Plan of Subdivision File No. 12T-20-002, pursuant to Section 51(58) of the Planning Act, R.S.O. 1990, C.P. 13, as amended; AND WHEREAS Bancroft Ridge Development Inc. entered into an Assignment and Assumption of Contracts Agreement with FS Alliance Bancroft Inc. to assign the Subdivision Agreement between the Corporation of the Town of Bancroft and Bancroft Ridge developments Inc. to FS Alliance Bancroft Inc.; NOW THEREFORE BE IT RESOLVED THAT the Corporation of the Town of Bancroft does hereby consent to the assignment of the Subdivision Agreement, dated April 12th, 2022, from Bancroft Ridge Developments Inc. to FS alliance Bancroft Inc.
